EXCLUSIVE: Robert Kennedy Jr. will admit to an affair with socialite - but will say it only happened AFTER she filed for divorce, her lawyers state

Robert F. Kennedy Jr. will admit to a relationship with a Connecticut socialite if forced to testify in court - but will argue it started only after she filed for divorce, her lawyers state.
The Kennedy scion, who only married actress Cheryl Hines in August, is being dragged into the bitter divorce battle between Chelsea Kirwan and her estranged husband, plastic surgeon to the stars Laurence Kirwan.
As DailyMail.com reported, the father-of-six is now being subpoenaed over the exact nature of his relationship with Mrs Kirwan.

Dr Kirwan’s lawyers have filed a motion to depose Kennedy, 60, in New York State on February 10 and he can be called upon under New York State law to testify. 
However, Mrs Kirwan's lawyers argued at Stamford Superior court in Connecticut on Monday that Kennedy should NOT be deposed, saying it is merely a measure to 'harass, embarrass, oppress and annoy' her.
And, they added, Kennedy's testimony is 'immaterial to the issues before thus court'.
Court papers obtained by DailyMail.com go on to reveal: 'The actions of Dr Kirwan which led up to his wife's filing for divorce are well known by him and have nothing to do with any alleged affair by the wife with anyone, much less the proposed deponent.

Upon information and belief, if compelled to testify, Mr Kennedy will testify that he did not have a sexual relationship with the Plaintiff prior to her filling for divorce.

As part of the legal argument to get Kennedy's deposition banned, the court papers state it is an attempt to subject anyone 'directly or indirectly connected' with her, by 'subjecting such persons to examination about their personal lives under oath and speculating about such details in the media'. 
As previously reported, Dr Kirwan, 62, was aware that his former wife had enjoyed a close friendship with Kennedy.
A source told DailyMail.com: ‘Laurence was well aware that his wife and Bobby had a friendship before their split and that they have had ongoing telephone calls.’

Kennedy, who this month was seen hobnobbing with his wife Cheryl Hines, potential 2016 Presidential candidate Hillary Clinton and his mother Ethel Kennedy at the RFK Ripple Of Hope Gala at the Hilton Hotel in Manhattan, allegedly had a two-year 'affair' with Mrs Kirwan, 42, which was reported earlier this year.
Soon after the news became public, a source said Kennedy was set to be questioned under oath as part of the Kirwans' divorce case, saying: 'Chelsea fears Laurence’s lawyers want to discredit her as a wife and a mom.' 
The pair were also pictured together at an event in Seattle in April 2013, where Bobby feted mountaineer Jim Whittaker. And she is believed to have accompanied him around the country.
Mrs Kirwan filed for divorce in 2012. Dr Kirwan's lawyers want to ascertain whether the friendship started during the Kirwans' marriage - and what the exact nature of the friendship was.

Kennedy married Curb Your Enthusiasm actress Cheryl, 49, on August 2 at the Kennedy compound on Hyannis Port, Mass, in front of the Kennedy clan, including his mother Ethel Kennedy, and watched by a starry crowd including Cheryl’s former co-star and good friend Larry David and Julia Louis-Dreyfuss, while Natasha Bedingfield serenaded them.
He was married to Emily Black between 1982 until 1994 and they had two children. 
His second wife, Mary Richardson Kennedy - the mother of four of his children - killed herself in May 2012.
And asked about their relationship, Cheryl said: 'We share the same values. Family first. We like to have a good time and work hard. It’s fun to have a partner...It’s a good match-up.'

The new Mr and Mrs Kennedy have since bought a $5 million home in Malibu, California, and Kennedy now spends the majority of his time on the West Coast with his family.
He is believed to be spending two days a week in New York teaching at Pace Law School.

The Kirwans have had an acrimonious split. 
They have three children together and Mrs Kirwan has a daughter from a previous marriage.
Last month, Dr Kirwan had charges dropped after completing two years probation after being charged with attacking his ex-wife and step-daughter at their home in Connecticut.
He also has been reinstated at the Hospital of St John and St Elizabeth in St John’s Wood, London, following a month-long suspension after his arrest.
However, Dr Kirwan, who has offices in London, New York and Connecticut, is now dealing with another legal issue after a bookkeeper at his Norwalk, Conn. office was accused of stealing at least $209,075.
Gloria Tamayo, 43, was arrested after Norwalk Detective William Maloney, a certified fraud investigator, examined financial records in Dr Kirwan’s office. 
He discovered Tamayo had been writing unauthorized checks since 2010, embezzling at least $209,075, according to the Hour report.
When reached by Daily Mail Online, Dr Kirwan declined to comment, while Chelsea Kirwan declined to comment.

    For Joe Riquelme's parents, the miracle came in the form of a plain white envelope containing a handwritten note from their son telling them he had paid off their mortgage.
    Riquelme, a successful app developer from New York who goes by the YouTube user name joeytrombone, on Thursday shared a video showing his parents’ heartwarming reaction to his incredibly generous Christmas gift.

    The touching video, which has been viewed nearly 130,000 times in the last 24 hours, and counting, begins with Joe Riquelme sitting on a couch with his parents and their pet dog.
    Looking visibly nervous and struggling to keep his emotions in check, Riquelme tells his mom and dad that he has one more Christmas gift for them: a slightly dog-eared envelope folded in half.
    Inside, there are documents from Bank of America accompanied by a handwritten note that reads: 'Your house is paid off. Merry Xmas. - Joe.'

    Confronted with the note, Riguelme's mother covers her mouth in shock and bursts into tears of joy mingled with laughter as her son labors to keep his composure.

      Demonstrators took to the streets for a second night after a white police officer in Berkeley, Missouri, killed a black 18-year-old who police said pointed a gun at him.
      Dozens of protesters held a vigil late Wednesday at the gas station in the St Louis suburb where Antonio Martin was shot, and they briefly blocked traffic on Interstate 170 during a march before returning to the station. Berkeley Police Chief Frank McCall told KMOV-TV that six to eight people were arrested.
      Later, about 75 people staged a peaceful protest early Christmas morning outside of a nearby church, according to the St Louis Post-Dispatch. Police in riot gear were present.
      The actions were calmer than a night before, when a crowd of about 300 people gathered at the gas station, throwing rocks and bricks in a scene reminiscent of the sometimes-violent protests that followed the death of 18-year-old Michael Brown in nearby Ferguson.
      Unlike in the death of Brown, who was unarmed and whose shooting was not captured on video, Berkeley Mayor Theodore Hoskins said Wednesday that surveillance footage appeared to show Martin pulling a gun on the unidentified 34-year-old officer who questioned him and another man about a theft at a convenience store.

      Hoskins urged calm, saying, “You couldn’t even compare this with Ferguson or the Garner case in New York,” a reference to the chokehold death of Eric Garner, another black man whose death was caused by a white police officer.
      Hoskins, who is black, also noted that unlike in Ferguson – where a mostly white police force serves a mostly black community – more than half of the officers in his city of 9,000 are black, including top command staff.
      State senator Maria Chappelle-Nadal, a Democrat who has been critical of how police handled the Brown case, also said the Martin shooting was far different than Brown’s, noting that Martin pointed a weapon at the officer.
      “That officer not only has an obligation to protect the community, but he also has a responsibility to protect himself,” said the senator, who is black. “Because of the video, it is more than apparent that his life was in jeopardy.”
      But Taurean Russell, co-founder of Hands Up United, asked if police had any reason to question Martin in the first place. Mistrust of police remains high among blacks, many of whom are weary of harassment, said Russell, who is black.
      St Louis County Police Chief Jon Belmar did not provide more details Wednesday about the theft Martin was being asked about. He said Martin pulled a loaded 9mm handgun and the officer fired three shots while stumbling backward. One hit Martin, who didn’t fire his own gun. He died at the scene.
      “I don’t know why the guy didn’t get a shot off, whether his gun jammed or he couldn’t get the safety off,” said attorney Brian Millikan, who is representing the officer. He said that the officer was lucky to be alive and certain he had no choice but to use lethal force.
      Police throughout the country have been on alert since two New York officers were gunned down in an ambush last weekend by a man who had made threatening posts online about killing police. He later killed himself.
      St Louis County police and the city of Berkeley are investigating the shooting of Martin, which Belmar called a tragedy for both Martin’s family and the officer, who has been on the force for six years.
      “He will carry the weight of this for the rest of his life, certainly for the rest of his career,” Belmar said of the officer. “There are no winners here.”
      The officer wasn’t wearing his body camera, and his cruiser’s dashboard camera was not activated because the car’s emergency lights were not on, Belmar said.
      Police released surveillance video clips from three different angles. The men can be seen leaving the store as a patrol car drives up. The officer gets out and speaks with them.
      About 90 seconds later, one appears to raise his arm, though it’s difficult to see what he’s holding because they were several feet from the camera. Belmar said it was a 9mm handgun with one round in the chamber and five more in the magazine.
      Police were searching Wednesday for the other man, who ran away.
      Belmar said Martin had a criminal record that included three assault charges, plus charges of armed robbery, armed criminal action and unlawful use of a weapon.
      Phone messages left for his parents were not returned. His mother, Toni Martin-Green, told the Post-Dispatch that Antonio was the oldest of four children.
      “He’s like any other kid who had dreams or hopes,” she said. “We loved being around him. He’d push a smile out of you.”
      His was the third fatal shooting of a young black man by a white police officer in the St Louis area since Brown was killed by Ferguson officer Darren Wilson on 9 August. Kajieme Powell, 25, was killed 19 August after approaching St Louis officers with a knife. Vonderrit Myers, 18, was fatally shot on 8 October after allegedly shooting at a St Louis officer.
      Each killing has led to protests, as did a grand jury’s decision last month not to charge Wilson in Brown’s death.
